Conditions of participation for competitions on https://www.onlineapo.at/ and https://www.facebook.com/RosenApothekeRosental
1. scope of application, obligations and costs
These terms and conditions apply when people take part in competitions and contests organised by Rosen-Apotheke, Längdorfer Straße 2, 9184 St. Jakob im Rosenthal (hereinafter referred to as "the organiser") https://www.onlineapo.at/. Participation is free and voluntary and without obligation for the participants. Legal recourse is excluded.
2. eligibility to participate
Residents with permanent residence in Austria are eligible to participate in competitions and competitions on https://www.facebook.com/RosenApothekeRosental. A person may only participate once per competition. Automated entries are excluded from participation. The organiser reserves the right to request proof of fulfilment of the above requirements from participants. If proof is not provided upon request, the participant may be excluded from the promotion by the organiser. Furthermore, the organiser reserves the right to exclude participants who violate criminal law, common decency or these terms and conditions from participation with immediate effect.
3. rights of third parties
Participants declare that their entries to the competition (e.g. texts, drawings or photographs) do not infringe the rights of third parties, in particular copyrights and personal rights. If other persons were involved in the creation or development of the entry, they must agree to its submission and subsequent publication as part of the competition. The same applies if third parties have been granted exclusive rights to the submitted entries. Even if other persons are recognisable in the photographs or drawings submitted, their consent to the submission and subsequent publication must be obtained.
4. settlement
Payment of the prize in cash or in kind, its exchange or transfer to other persons is not possible. In the case of prizes in the form of a voucher, payment of the prize, sale and transfer of the voucher is not permitted. Notification of the prize will be sent by email or Facebook message within 14 days of the closing date for entries. The organiser reserves the right to publish the winner on https://www.facebook.com/RosenApothekeRosental. If there is no response from the winner within 14 days, the organiser reserves the right to select a new winner. If the contact details provided are incorrect (e.g. postal or e-mail addresses), the organiser is not obliged to search for correct addresses. Any disadvantages arising from the provision of incorrect contact details (e.g. incorrect postal or e-mail address) shall be borne by the entrant. Should it be established upon delivery that prizes are faulty or damaged, the Organiser must be notified within seven days of the delivery date, otherwise the prize will be deemed to have been accepted as delivered. This does not affect the legal rights of the winners. If entering via Facebook, the winner will be notified by the Promoter and the winner must contact the Promoter within 48 hours to claim their prize. If no claim is made by the winner within 48 hours, the organiser reserves the right to forfeit the prize. Facebook itself has no connection with the competition and is therefore excluded from any liability.
5. data protection information on the competition
The data entered by the participants to take part in the competition will only be used for the processing and handling of the competition and will not be passed on to third parties, apart from the publication below. The participant agrees that his/her submissions to the competition and the personal data submitted (first name, surname, location, photograph or other electronic materials) may be published in connection with the competition, its draw and processing on https://www.facebook.com/RosenApothekeRosental, the websites https://www.onlineapo.at/. The participant may revoke the publication of his/her personal data during the course of participation or subsequently.
6 Changes to the rules of participation and cancellation of the competition
The organiser reserves the right to change the conditions of participation at any time. Furthermore, the organiser reserves the right to terminate or interrupt the competition or prize draw at any time for good cause without prior notice. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from proceeding as planned.
7. additional conditions
Further conditions of participation (e.g. type and duration of the competition, type and scope of the prize) are specified in the respective competition. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. They shall be replaced by an appropriate provision that comes closest to the purpose of the invalid provision.
